Contempt of Court FAQs - Odessa, Texas

Common questions about contempt of court in Texas answered by our experienced attorneys.

What is contempt of court in a family case?

Violating a court order — unpaid child support, denied visitation, undelivered property. Under Family Code Chapter 157, courts can punish each proven violation with up to 6 months in jail and a $500 fine, plus attorney's fees and make-up time.

Can I really go to jail for not paying child support?

Yes — contempt carries up to 6 months per missed payment proven. But documented inability to pay (involuntary job loss, medical issues) is a real defense under §157.008, and most first-time cases resolve with payment plans when handled before the hearing.

My ex denies my visitation — what can I do?

Document every denied exchange (texts, a witness, a police standby report), then file a Motion for Enforcement. Ector and Midland County judges order make-up visitation, fines, attorney's fees, and — for repeat offenders — jail.

Can I withhold visitation if child support isn't paid?

No. Support and visitation are legally independent — withholding visits over money puts YOU in contempt. Enforce the support order through the court instead; the remedies are powerful and fee-shifting is nearly automatic.

Who pays the attorney fees in an enforcement case?

Usually the violator. In child support enforcement, Family Code §157.167 makes fee awards to the winning parent essentially mandatory absent good cause — and those fees can be collected like child support itself.

Excellent attorney! Made the process smooth/painless and always had my best interest in mind. Did not make me feel like a client but more like a family. Would recommend to anyone looking for an attorney for child support or divorce. Thank you, Mr. Robles for representing me and my baby boy!
